1. Acceptance of Terms

By accessing or using DeathNote ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

DeathNote provides a digital legacy management platform that enables users to:

• Create and store encrypted digital messages
• Schedule message delivery upon verification of passing
• Set up proof-of-life verification systems
• Use guided eulogy-writing tools
• Designate recipients for posthumous communications

3. Account Registration

To use certain features, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

You may not use another person's account without permission or create multiple accounts for fraudulent purposes.

4. User Content & Ownership

You retain ownership of all content you create on our platform. By using our Service, you grant us:

• A license to store, process, and deliver your content as directed
• The right to create backups for reliability and security
• Permission to transmit content to designated recipients
• Authority to comply with legal obligations regarding your content

You are responsible for ensuring you have the right to share any content you upload.

5. Prohibited Uses

You may not use our Service to:

• Violate any laws or regulations
• Harass, abuse, or harm others
• Distribute malware or harmful code
• Impersonate another person or entity
• Share content that infringes on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Use the Service for illegal or fraudulent purposes
• Interfere with or disrupt the Service

6. Service Availability & Limitations

We strive to maintain 99.9% uptime but cannot guarantee continuous availability. Users should maintain independent backups of critical information.

7. Payment Terms

DeathNote is free to use. There is no subscription and no recurring charge. Creating and storing notes, designating recipients, proof-of-life check-ins, and automated delivery are all included at no cost.

The only optional paid feature is extra AI grief-writing usage. Every account receives two free AI writing actions per day, shared across the eulogy and obituary builders. Beyond that daily allowance, each additional generate or customize action uses one shared credit. A single credit is a one-time charge of $0.99. These charges are not a subscription and do not renew.

• You will be charged only when you choose to generate or customize an eulogy or obituary beyond your shared daily free allowance
• Refunds are provided according to our refund policy
• You're responsible for any applicable taxes

8. Privacy & Data Security

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you consent to our data practices as described in the Privacy Policy. We implement industry-standard security measures but cannot guarantee absolute security.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

DeathNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. These limitations apply regardless of the legal theory on which the claim is based.

11. Indemnification

You agree to defend, indemnify, and hold harmless DeathNote, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your content.

12. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by DeathNote and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used without prior written consent.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Illegal or harmful activities
• Extended account inactivity
• Any reason at our sole discretion

Upon termination, your right to use the Service will cease. Scheduled messages may be cancelled.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our Service. Your continued use following changes constitutes acceptance of the revised Terms. If you disagree with changes, you should discontinue use of the Service.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and DeathNote regarding the use of the Service, superseding any prior agreements. Any failure to enforce any provision shall not constitute a waiver of such provision.
